Fan productions and Fair use

I had a question from a member on fair use laws, now that Japan is considering a 'fair use' law of copyrighted material, much like one we have in the United States. This does not mean that if a 'fair use' law in Japan is passed, that all Gackt fanvids can stay up on YouTube.
YouTube (and other servers such as YouTube, and livejournal for that matter) host materials at their discretion and by their terms of service, (distinct of national and international law) recently, a comics livejournal account was suspended for sharing scans of comics. The hosting service will always come in on the side of the copyright holder, to save themselves from liability.
As regards Gackt vids on YouTube and Veoh, fair use will be determined by those persons owning copyright (Gordie, on behalf of Gackt, NHK on behalf of it's productions, etc.) not the poster.
